Former FTX CEO Sam Bankman-Fried Faces Bail Revocation Over Alleged Witness Tampering

Federal prosecutors have taken the extraordinary step of revoking Sam Bankman-Fried’s bail as he awaits trial. According to the Associated Press, authorities are saying that Bankman-Fried leaked personal writings of Caroline Ellison, the former CEO of FTX’s sister business, Alameda Research, to the New York Times.

Caroline Ellison, who had a love involvement with Bankman-Fried, is scheduled to testify at his trial. Prosecutors claim that Bankman-Fried’s acts amount to witness tampering, which is why they first sought a gag order. They now argue that no bail terms will suffice to keep him from influencing witnesses and are requesting that he be imprisoned immediately.

Mark Cohen, Bankman-Fried’s lawyer, stated his client’s not guilty plea, expressing astonishment at the prosecutors’ last-minute jail request made only seconds before the last hearing.

Judge Lewis A. Kaplan has given both parties several days to make written arguments on the topic that demonstrate a fair regard for the government’s interests as well as Bankman-Fried’s First Amendment rights, notably his right to free expression. He also gave Bankman-Fried a harsh warning, asking him to take the government’s request seriously.

Judge Kaplan had already hinted at incarcerating Bankman-Fried owing to his frequent efforts to circumvent electronic communication limits. After suspicions about his interaction with other persons associated with FTX developed in February, both prosecutors and Bankman-Fried’s legal team agreed on communication limits.
